The failure to diagnose a condition is one of the most common types of misdiagnosis.

"Many people assume that medical malpractice is mainly about surgical errors. However, the highest dollar payouts are often related to misdiagnosis, failure to diagnose or delayed diagnosis of a severe medical condition. The top five diseases in terms of dollar payouts include breast cancer, lung cancer, colorectal cancer, heart attack, and appendicitis. In all these diseases, the typical allegations are misdiagnosis or delayed diagnosis by failing to notice the disease or mismanaging the diagnostic testing process.

Malpractice lawsuits from failure or delayed diagnosis occur mostly, in terms of dollar value, from conditions such as heart attack, breast cancer, appendicitis, lung cancer, and colon cancer. However, these are not the most common undiagnosed conditions, but are simply the ones that lead to the most rapid damages. Serious conditions such as diabetes and hypertension are very commonly undiagnosed, but do not lead as rapidly to severe injury (and hence to dollar awards in malpractice lawsuits). "

I think it's fair to say that when we get a diagnosis, we will want compensation for all the HELL we went through. Some of these doctor's are NOT doing their jobs as medical professionals and are sitting back while we as patients are forced to suffer in silence. In my case, I believe a doctor CAUSED my illness by putting me on brith control. She's retired now, probably soaking up some sun at a beach in Hawaii, not even realizing the harm she caused on my body. These doctors have more than enough money to pay up for their mistakes and failures. This is another reason to keep up the search.. justice!

When all else fails, play dead!


Another reason is to stop the pain. Dr House (Season 1 Episode 10) said he took vicodin because 'I'm in pain.' Quickly followed by the patient saying 'Aren't we all.'
This occurred to me because we, as well as doctors frequently get caught up in fixing symptoms, not the cause. We may also have other problems. Like me, I have a very sore back, but it's because I spent all day yesterday at the royal melbourne show working my butt off(figuratively). If I went to the doctor complaining of a headache and a sore back, that just doesn't fit with vitamin e deficiency, so they can either fit it with another diagnosis, or temporarily fix the symptoms, and get me to come back and spend more money if the headaches and back pain continue.

Doctors are people, with a wish to improve their financial situation.

Told You It Was Not All In My Head!


I actually never considered suing for malpractice until a few weeks ago. I have always been "Well whatever I have must be rare, so they just arent thinking of it" which may still be the case. BUT, after the fiasco with the pneumonia and the vomiting, and with me now even telling the doctors what would b a great test (scleroderma) they refuse to do so. Scleroderma can be deadly if the symptoms are not managed. Also, just dumping a fibromyalgia diagnosis on me with no supporting evidence and ignoring me ever after can also be malpractice. So I am seriously considering it now.

I Will Be Diagnosed !


I've never thought about Malpractice, just going back to previous Doctors who told me "all in my head" and explaining what other health issues were picked up....in your face type thing  Wink

Really I don't think a Malpractise could go ahead unless you finally have a diagnosis  Confused  Question Question correct me if I'm wrong  Confused

Nope, you're right Sammy.

We have to be officially diagnosed to sue for malpractice.. all the more reason to look for a diagnosis!  aggressive

Trouble is - which doctor do I sue? Where do you put the point of no return?
I've had well over 20 doctors, private and hospital ones.

I'd put the point when my vitamin e level hit zero, then my mood swings hurt me and my physical mobility stopped getting worse (you can't go lower then nothing)

I know which docs and medical facility's to sue. I have kept careful records. I am not sure I will, but once I am diagnosed, as f right now I do want to sue. Not for failure to diagnose, but for failure to even TRY to diagnose or to even treat the pain and vomiting.
